Public Seal Power Struggle: AG Dorcas Oduor Responds to Allegations of Being Sidelined
Attorney General Dorcas Oduor has firmly denied claims that the custody of Kenya’s Public Seal has been transferred to the Head of Public Service, Felix Koskei, amid speculation of internal power struggles within President William Ruto’s broad-based government.
Addressing journalists on Thursday, Oduor clarified that the Public Seal remains under her legal custody, as required by law. “The custody of the Public Seal is provided for by law, and that position remains unchanged. The Seal is still in my custody contrary to what has been reported in the media,” she stated.
The AG’s remarks come in response to growing confusion and contradicting public statements by senior government officials. Government Spokesperson Isaac Mwaura initially claimed on May 19 that the seal had been moved to the Head of Public Service. However, on May 22, he retracted his statement, affirming that the seal was still in the AG’s office.
Former Attorney General Justin Muturi also weighed in, warning that shifting control of the Public Seal could be an attempt to bypass legal oversight. “If documents can be signed and bear the public seal without the AG’s legal advice, that is a serious issue. I’m sure that they are avoiding accountability by transferring such matters to the HOPS office,” Muturi told The Standard.
Dorcas Oduor, who took office during a government reorganization that included opposition leaders, dismissed the idea of being sidelined. “As a government, we work together under the leadership of the President, as a united team,” she said, emphasizing harmony in the administration.
The Importance of the Public Seal
The Public Seal is one of Kenya’s four national symbols, alongside the national anthem, flag, and coat of arms. It serves as the state’s official signature, authenticating agreements, treaties, and financial commitments on behalf of the Republic of Kenya. Under Chapter Two, Part Nine of the Constitution, the Attorney General is the lawful custodian of the seal.
Its possession is no small matter. From securing international loans to signing trade agreements and leasing national assets, the Public Seal wields enormous power. Any unauthorized transfer or misuse raises questions about transparency and legal accountability within government.
The unfolding drama over its custody points to deeper institutional tensions within Kenya’s executive branch. With the High Court already active on multiple political fronts, further legal clarification could be sought if doubts persist.
As it stands, Attorney General Dorcas Oduor has asserted her constitutional mandate and responsibility over one of the most powerful symbols of the Kenyan state.
