Petition Filed to Stop Arrest of Rigathi Gachagua
A fresh legal battle has erupted at the Milimani Law Courts after a petition was filed seeking to bar the arrest of former Deputy President Rigathi Gachagua. The petitioner, activist George Mogire, through lawyer Moses Mabeya, has urged the High Court to issue conservatory orders that would protect Gachagua from any imminent arrest, prosecution, or detention.
The petition names the Inspector General of Police, the Director of Public Prosecutions (DPP), and the National Cohesion and Integration Commission (NCIC) as respondents. Mogire argues that recent efforts to detain or prosecute Gachagua are politically motivated and unsupported by credible evidence of criminal wrongdoing.
According to court documents, the petitioner claims the state agencies involved are acting under political influence and have deviated from their constitutional duties. Mogire insists that Gachagua is facing persecution for his outspoken political views, particularly remarks made during a May 17 interview, which were later referenced in a heated National Assembly session on May 27.
“Pending the hearing and determination of this application, this Honourable Court should issue conservatory orders restraining the respondents and their agents from arresting, detaining, or interfering with Gachagua’s liberty,” the petition reads in part.
Mogire further argues that the former deputy president’s freedom of expression, as guaranteed under Article 33 of the Constitution, is being unfairly targeted. He describes the attempts to prosecute Gachagua as an orchestrated campaign to silence dissent and marginalize opposition voices.
The petition also alleges selective application of the law by the NCIC, accusing the agency of political bias and failure to act with impartiality. “The respondents have abdicated their constitutional mandates and are being used as instruments of political retaliation,” the petitioner states.
The High Court is expected to review the application in the coming days. Meanwhile, political temperatures continue to rise, as allies and opponents of Gachagua watch the legal developments closely.
