Kisumu Horror: Man Sentenced to Life for Defiling Two-Year-Old Girl

A Kisumu court has sentenced a middle-aged man to life in prison after finding him guilty of the horrifying defilement of a two-year-old girl.

The man, identified as Donard Shimiyu Ondieka, committed the offence in February 2024 in Nyalenda B Sub-location within Kisumu Central, where he lived as a neighbour to the victim. The shocking case, which drew public outrage, has finally concluded with a stern judgment from Principal Magistrate Fatuma Rashid.

While delivering the sentence, Magistrate Rashid underscored the gravity of the offence, stating that the court relied on three key legal thresholds for defilement convictions: proof of penetration, confirmation that the victim is a minor, and the positive identification of the perpetrator. She noted that all elements were proven beyond reasonable doubt.

“The evidence presented, including the medical report and the witness accounts, supports the prosecution’s case. The victim’s age and vulnerability, coupled with the trust breached, aggravate the offence,” Magistrate Rashid stated.

The prosecution, led by the Office of the Director of Public Prosecutions (ODPP), called four witnesses to the stand. Among them was a medical officer who examined the child and submitted clinical findings that corroborated the defilement. Other witnesses included close family members and local authorities.

According to the ODPP, the conviction was secured under Section 8(1) as read with Section 8(2) of the Sexual Offences Act No. 3 of 2006. The Act prescribes a mandatory life sentence for persons convicted of defiling a child aged 11 years or younger.

This case adds to the growing list of child sexual abuse cases in Kenya, raising serious questions about child safety and community vigilance. Human rights groups have lauded the judgment, urging the public and government institutions to work together in protecting vulnerable children from sexual predators.

The sentencing of Donard Shimiyu sends a strong message that crimes against children will be met with the full force of the law.
