Former Govt Delivery Chief Peter Mbae Files ICC Complaint Against CS Murkomen

Dr. Peter Mbae, former Head of the Government Delivery Services, has formally petitioned the International Criminal Court (ICC) for prompt and urgent intervention following controversial remarks made by Interior Cabinet Secretary Kipchumba Murkomen regarding the 2027 presidential election.

The complaint stems from a public statement made by CS Murkomen on April 14, in which he declared that President William Ruto would win re-election in 2027 “under all circumstances.” Mbae contends that the remarks pose a threat to democratic processes and raise fears of a repeat of Kenya’s 2007 post-election violence.

“We have sent a copy of this letter to the prosecutor of the ICC for prompt, immediate, and urgent interventions by the court to open an investigation on the Kenyan situation to prevent the possibility of a repeat 2007 violence,” the letter reads.

Mbae emphasized that Murkomen’s remarks appeared to allude to the 2007 election crisis, which saw widespread violence and loss of life.

In a follow-up letter dated April 16 addressed to the Ministry of Interior, Mbae condemned the CS’s statements, which were widely aired in the media. He demanded public reassurances from Murkomen that the government would ensure the 2027 general elections are conducted in a free, fair, and transparent manner.

“The statement was to the effect that the outcome of the 2027 Presidential Election is predetermined and that President Ruto will win under all circumstances,” the letter stated.

Mbae further demanded confirmation from the Cabinet Secretary that the state would guarantee a peaceful election period, free from violence, suppression, and intimidation.

“The only probable conclusion is that the current administration shall employ all means possible to ensure the outcome is as stated by the Cabinet Secretary,” Mbae concluded.

The petition to the ICC is seen as a preemptive effort to protect electoral integrity and deter any potential crimes against humanity that could emerge from a flawed or violent electoral process.
