“Court Will Give Me Justice”: Gachagua Speaks After Court Finds Illegality in His Ouster
Former Deputy President Rigathi Gachagua has broken his silence after the Court of Appeal dealt a significant blow to the process that led to his removal from office, ruling that the judicial procedure used was unconstitutional.
Speaking during a church service in Juja, Kiambu County, Gachagua expressed confidence that Kenya’s judicial system will eventually vindicate him, citing the Court of Appeal’s decision to quash a directive by Deputy Chief Justice Philomena Mwilu. The directive, issued in October 2024, had appointed a three-judge bench to hear a petition challenging Gachagua’s removal—a move now deemed illegal by the appellate court.
“The framers of the 2010 Constitution created four levels of judicial intervention—the Magistrate’s Court, the High Court, the Court of Appeal, and the Supreme Court—so that if you don’t get justice in one, you’ll get it in another,” Gachagua stated, receiving cheers from the congregation.
“In those courts, we have judges of integrity who will give justice not only to Rigathi Gachagua, but to the people of Kenya.”
Judicial Misstep Exposed
The appellate court ruled that the authority to empanel a bench for such petitions lies solely with the Chief Justice—not the Deputy Chief Justice. As such, the ruling has not only revived Gachagua’s political momentum but also cast doubt on the legality of Kithure Kindiki’s current appointment as Deputy President.
The case now heads back to Chief Justice Martha Koome, who is expected to decide whether to reconstitute a legally valid bench to hear the petition afresh.
Ruto’s Toughest Challenger Yet?
Far from stepping back, Gachagua doubled down on his political ambitions, announcing plans to launch a new political party that he believes will unseat President William Ruto in 2027. He revealed that the new outfit will be backed by some of the most formidable names in Kenyan politics, including:
- Kalonzo Musyoka
- Martha Karua
- Fred Matiang’i
- Eugene Wamalwa
“They are praying to God that we disagree. But I urge Kenyans to pray for our unity so that we can liberate this country,” Gachagua declared.
He hinted at ongoing conversations with other political heavyweights such as Mukhisa Kituyi, Justin Muturi, and Mithika Linturi.
Political Fallout
Gachagua’s removal from the Deputy President’s seat earlier this year sparked major political shockwaves, particularly in the Mt. Kenya region where his support remains strong. Allies of President Ruto have consistently downplayed his relevance, with some mocking his return to the political limelight.
But following the court’s ruling, political analysts believe the tide may be shifting.
