Cabinet Endorses Special Retirement Scheme for Judges

In a significant policy shift, the Cabinet has endorsed the Judges Retirement Benefits Bill, 2025, which introduces a special pension scheme tailored exclusively for judges of Kenya’s superior courts.

The proposed law moves judges out of the general Pensions Act and into a unique retirement structure, reflecting the high standards and responsibilities of judicial service. The new system features a defined benefit plan for currently serving judges and a defined contribution plan for future judicial appointments.

“This is aimed at strengthening judicial independence and attracting the most qualified legal professionals,” a Cabinet dispatch noted following a meeting chaired by President William Ruto at State House on April 29.

In addition to financial security, the bill outlines a wide range of benefits for retired judges, including:

  • Monthly pensions and gratuities based on final salary and years of service
  • Comprehensive medical coverage
  • Diplomatic privileges for retired judges and their spouses
  • Reversionary pensions for surviving spouses, including same-sex partners

The package is designed to ensure judges can retire with dignity after decades of service under strict ethical constraints.

Judges in Kenya generally serve until the age of 70, though early retirement is permitted from age 65. The Chief Justice is limited to a 10-year term but may remain on the bench as a Supreme Court judge until reaching the mandatory retirement age.

Gratuities will be paid either as a lump sum or partially converted into a lifelong pension, with any remaining amount supporting dependents in the event of death.

This bill marks a strategic move to enhance the judiciary’s working conditions and protect its autonomy, while ensuring a secure and honorable retirement for those who have served at the highest levels of the legal system.
