Kisumu Woman Awarded KSh 500,000 After Husband Moves Lover Into Family Home
A woman in Kisumu County has been awarded KSh 500,000 in damages after the High Court found that her husband’s decision to move another woman into their marital home violated her constitutional rights.
According to a report published by Taifa Leo on Tuesday, October 20, High Court Judge Alfred Mebeya ordered the husband, identified as GOB, and the other woman, FC, to jointly compensate his wife, BAC.
The court also directed FC to leave the family home in Kombewa within 14 days of the ruling.
How the dispute began
BAC told the court that she married GOB in a Christian ceremony on March 16, 1996. The couple had been living in their Kombewa home since 2017.
In her account to the court, BAC said the dispute escalated on May 13, 2026, when her husband arrived home with FC without consulting her or obtaining her agreement.
She said her husband’s decision to allow FC to remain in the household infringed upon her rights to dignity, privacy, health and peaceful enjoyment of the family home.
BAC also argued that the arrangement negatively affected the wellbeing of the couple’s three children, all of whom are under the age of 18.
Why the High Court awarded damages
Judge Mebeya agreed with BAC’s position, finding that her husband’s conduct violated her human dignity.
The court ordered the husband and FC to pay the woman KSh 500,000 jointly and directed FC to vacate the home within the specified 14-day period.
The ruling addressed the wife’s constitutional rights and the circumstances surrounding the presence of another woman in the marital household.
Why the identities were withheld
The parties were identified only by their initials to protect the identities of their three minor children, who live with their mother.
The case highlights a dispute involving dignity, privacy and the rights of family members within a shared home.
